USCIS said this time it would consider spouses “E” and “L” to be authorized to work based on their valid neither E nor L immigrant status.

The US immigration service recently updated the work permit guide with which certain spouses of foreigners with “E” and “L” visas (businessmen and executives) can apply for employment authorization (EAD) while waiting for the green card to arrive.
The Office of Citizenship and Immigration Services USCIS reported that “certain ‘E’ and ‘L’ nonimmigrant spouses may be used as evidence of employment authorization based on their nonimmigrant status.”
This change was announced last November when The entity indicated that it would once again process and grant work permits to businessmen and executives with “E” and “L” visas while they waited for the green card to arrive.

From the ad, “the Department of Homeland Security (DHS) added new Class of Admission (COA) codes to differentiate between spouses of children ‘E’ and ‘L’”.
“As of January 30, USCIS and Customs and Border Protection (CBP) began submitting Forms I-94 with the following new COAs for certain ‘E’ and ‘L’ spouses: E-1S, E-2S , E-3S and L-2S”the agency explained.
Also, he pointed out that “an unexpired Form I-94 that has one of these new codes will be accepted as evidence of employment authorization for spouses under List C of Form I-9”.
“If you are an ‘E’ or ‘L’ spouse age 21 or older who has an unexpired Form I-94 that USCIS issued before January 30, we will mail you notice beginning April 1, 2022 or around that date“.
“This notice, along with an unexpired Form I-94 reflecting E-1, E-2, E-3, E-3D, E-3R, or L-2 nonimmigrant status, will serve as evidence of authorization of employment,” the USCIS said in the statement.
In the event that spouses “E” or “L” are under 21 years of age or if they have not received their respective notification before April 30, they recommend sending an email to E-Lmarried-U21@uscis.dhs.gov .
“We will only serve notices to persons identified as qualifying spouses based on a USCIS-approved Form I-539. Individuals who received their Form I-94 from CBP should visit http://www.cbp.gov.”
